Ohio Securities Act - The Need for Modernization of Remedies
Attorney Courtney M. Werning authored an article on Ohio securities laws entitled Ohio Securities Act – the Need for Modernization of Remedies. The article was published in the most recent edition of the Ohio Division of Securities Quarterly Bulletin. The Division of Securities is a department under the Ohio Department of Commerce and administers and enforces the Ohio Securities Act. It licenses securities salespeople and the securities themselves, and when Ohio securities law is violated, the Division can pursue administrative and civil actions.
In this article, Ms. Werning details why Ohio investors are at a disadvantage when it comes to the civil remedies available to victims of investment fraud and misconduct when compared to other state’s laws. Ms. Yeager makes the argument that Ohio should be brought into the majority of states that allow for attorneys’ fees as an available remedy for the winning party in securities litigation.
