Who chooses the mediator when a claim is handled in securities mediation
through FINRA?
Both parties have a say in the selection of the mediator, which is a neutral
third party who will facilitate the negotiations. You may choose a mediator
based on his or her background, experience, knowledge of the law and so
on. The mediator plays an important role, as this person will attempt
to help both sides see the important factors necessary to come to a resolution.
Keep in mind, though, that the mediator does not make a decision on the
case. Instead, he or she guides each party to a solution. If you are thinking
about pursuing a case against your broker, you should contact an experienced
securities mediation attorney. A knowledgeable lawyer will be able to help you reach a successful outcome.
